IN THE HIGH COURT OF DELHI AT NEW DELHI

+ W.P.(C) 12311/2018 SHANKAR LAL ..... Petitioner Through:

Mr Harsh Kumar, Advocate.

versus ICICI BANK LIMITED & ORS ..... Respondents Through:

Mr Puneet Bhalla, Advocate.

CORAM:

HON'BLE MR. JUSTICE VIBHU BAKHRU

O R D E R

% 13.12.2018 1.

The petitioner has filed the present petition, inter alia, praying as under:- "a.

Issue a Writ Of Mandamus Or Any Other Appropriate Writ, Order or Direction to the respondent no.l for direction to the respondent no.l for clearing the loan status from the vehicle particulars of the petitioner and further directing to give NOC for processing the insurance claim made to respondent no.2."

2.

It is the petitioner's case that respondent no.1 has not disbursed any loan to the petitioner either directly or through its agent and the documents executed by the petitioner for obtaining the said loan have been misused. 3.

Mr Bhalla, learned counsel appearing for respondent no.1 disputes the contention advanced by the petitioner. He, however, states that he has instruction that respondent no.1 shall give a No Objection Certificate for release of the hypothecation in respect of vehicle in question. Respondent

no.1, however, reserves its rights to action as are otherwise available in law. In view of the above submission, no further orders are required to be passed in this petition except to direct that the NOC shall be provided to the petitioner within a period of four weeks from today. It is so directed. 4.

The petition is disposed of in the aforesaid terms. VIBHU BAKHRU, J DECEMBER 13, 2018 RK
