W.P.(C) 8406/2017 & C.M. No.34601/2017 After some arguments, learned counsel for petitioner seeks permission of this Court to withdraw this petition. Record shows that an earlier WP(C) 6693/2017 had been filed by the same petitioner before this Court. The petitioner had impugned the order dated 24.7.2017 passed by the Chief Welfare Officer. That petition had been dismissed as withdrawn with liberty granted to the petitioner to approach the Appellate Division. The Appellate Division is the Joint Secretary. The petitioner informs this Court that he had filed an appeal before the Joint Secretary on 09.8.2017 which is yet pending before him. His apprehension is that this appeal may be decided by a person other than the Joint Secretary as the Joint Secretary has

remanded the matter back to the Chief Welfare Officer. Learned counsel for respondent who has appeared on advance notice ensures this Court that the appeal shall be decided by the Joint Secretary itself and if the matter has been remanded back to the Chief Welfare Officer only to comply with procedural formalities. Be that as it may, this statement of learned counsel for respondent is taken on record. It is clear that the Joint Secretary is the Appellate Body and he himself will decide the appeal. The petitioner is aggrieved by the certain intervening conduct of the Joint Secretary. His submission on this count is that the application filed before the Joint Secretary is not being entertained. The same shall be entertained by the Joint Secretary in accordance with law.
