EX.S.A. 4/2017 1.

After arguments and at the stage of dictation of the judgment not only for dismissing of the execution second appeal but possibly even for directions of registration of a criminal complaint against the appellant under Section 340 Cr.P.C. read with Section 209 IPC, counsel for the appellant, on instructions from the appellant who is present in person, states that this appeal be disposed of as not pressed and appellant undertakes to vacate the suit premises on or before EX.S.A. 4/2017

31.12.2017.

It is stated that the appellant will continue to pay the charges to the respondent/landlord in terms of the lease agreement dated 21.3.2016 and will also clear all charges towards electricity, water, etc. as payable by the appellant for the suit/tenanted premises till the possession of the same is handed over to the respondent/decree holder/plaintiff/landlord.

Let the appellant file an undertaking in this Court within a period of one week from today in terms of the present order and on the appellant filing the undertaking and complying with the terms of the same, while the appeal be treated as disposed of as not pressed the appellant is granted time to vacate the suit premises on or before 31.12.2017.
