This petition under Article 227 of the Constitution of India impugns the order (dated 12th September, 2017 in CS No.29/16 of the Court of Additional District Judge, Karkardooma Courts, Delhi) closing the evidence of the petitioner / defendant no.3 in the suit. 4.
The learned Additional District Judge, in the impugned order, has noted that the suit is 17 years old and has after so closing the evidence of the petitioner / defendant no.3 listed the suit for final arguments on 18th September, 2017. The learned Additional District Judge has further reasoned that as per directions of the National Court Management Systems Committee of the Supreme Court and the State Court Management System CM(M) No.1024/2017
Committee of this Court, suits over ten years old are not to be adjourned and have to be expeditiously disposed of.

At this stage, the counsel for the petitioner / defendant no.3 withdraws this petition stating that he will file an application before the Additional District Judge.

Dismissed as withdrawn.
