O R D E R

% 12.02.2016 After some arguments, it has been agreed that the suit property i.e. the suit shop measuring 8 ft. 6 inch x 19 ft. on the ground floor and one tin shed measuring 8 ft. 6 inch x 19 ft. on the first floor of the property bearing no.5289, Sadar Thana Road, Delhi-11006 will be vacated by the petitioner on or before 12.02.2017. In this intervening period user charges @ Rs.4000/- per month shall be paid by the petitioner to the landlord.

Needless to state that at the time of handing over vacant and physical possession of the suit shop to the landlord all electricity and water charges shall be cleared by the petitioner. Petitioner undertakes to pay this admitted user charges on or before 7th day of each english calendar month.

All these facts shall be incorporated in an undertaking in the form of an affidavit to be furnished by the petitioner within a period of 10 days from today with advance copy to the respondent/landlord. Learned counsel for the respondent apprehends that there may be some disputes at the time of handing over of possession of the suit property for which learned counsel for the petitioner assures this Court that the petitioner before this Court Rupinder Aggarwal will alone hand over the suit shop to the landlord and no other person will claim over the suit property.

Petition disposed of.
