ARB.P. 850/2018 1.
Issue notice. Learned counsel for the respondent accepts notice and submits that respondent has no objection to the appointment of an independent arbitrator by this Court.

There is a valid arbitration agreement contained in Clause 20 of the agreement reproduced in paragraph R of the petition. The disputes have arisen between the parties and the petitioner invoked the arbitration vide notice dated 20th August, 2018.

The petition is allowed and Mr. Justice Satish Kumar Agnihotri, Former Chief Justice of Sikkim High Court (Mobile:9498095770) is appointed as a sole arbitrator to adjudicate the disputes between the parties including their claims and counter-claims, if any.

The arbitration shall be conducted under the ageis of Delhi International Arbitration Centre.
5.
The learned arbitrator shall ensure the compliance of Section 12 of Arbitration and Conciliation Act, 1996 before commencing the arbitration. 6.
Copy of this order be sent to the DIAC as well as to the learned arbitrator.
7.
Copy of this order be given dasti to counsels for the parties under signature of Court Master.
