% 31.07.2019 The challenge in the writ petition is to the warrant of distress dated October 31, 2018 passed by the respondent. Mr. Sanjay Poddar, learned Senior Counsel appearing for the Corporation on instructions states, without prejudice to the rights of the respondent Corporation to make counter claim before the learned Arbitrator, the Corporation shall withdraw the impugned warrant of distress. The said statement is taken on record. In view of the fact that the Corporation intends to withdraw the warrant of distress, the present petition has become infructuous. The writ petition and connected application are dismissed. It is made clear that this Court has not expressed itself on the merit of the controversy.
