CORAM:

HON'BLE MR. JUSTICE NAJMI WAZIRI

O R D E R

% 19.11.2018 The petitioner is aggrieved by what he terms as gross negligence and inaction by the Investigating Officer in a complaint filed by him apropos trespass in his property and illegal and unauthorised construction thereon as well as forgery of documents. The learned counsel for the petitioner submits that, interestingly, the Investigating Officer has been intimated by the Sub-Registrar that the document presented by the petitioner as proof of the petitioner's ownership or right in the property has been verified, yet, the latter has taken no worthwhile action and the petitioner continues to be ousted from his property. It is after the Report from the Sub-Registrar that the FIR was filed. Nevertheless, it does not reflect the entire web of offences indulged in by the persons mentioned therein. He submits

that the Charge-sheet filed does not incorporate all the offences alleged by the complainant, in particular, forgery and cheating. In the circumstances, this petition shall be treated as a representation of the petitioner by the DCP of the area concerned. The petitioner shall appear before him on 27.11.2018 in the forenoon. The matter will be looked into by the DCP and orders and actions, as he may deem appropriate, would be passed or taken and duly communicated to the petitioner. Should the petitioner have any grievance thereafter, it will be open to him to seek legal remedies, as may be available to him. The petition is disposed off in the above terms. A copy of this order be given dasti to the petitioner, under the signature of the Court Master.
