% 26.09.2017 The petitioner is aggrieved by letter dated 03.08.2017 which was circulated by respondent No. 1.

During the course of the arguments, learned Additional Solicitor General points out that pursuant to the amendment in the Right to Education Act, 2015, in terms of Section 23(2) Proviso, the minimum qualification required for a teacher imparting education at the elementary level has been laid down in terms of this communication (now impugned). A training course is to be completed by all in-service teachers by 31.03.2019. Respondent No. 1 has outsourced this training to respondent No.2/National

Institute of Open Schooling (NIOS). NIOS has also been granted recognition by respondent No. 3 i.e. National Council for Teacher Education on 22.9.2017. Respondent No.3 is, in fact, the Regulator of this training. During the course of the arguments, learned ASG submits that as on date, more than 10 lakhs teachers have been registered with respondent No. 2 for this training. These are all in-service teachers. This has also been mentioned in the recognition order dated 22.09.2017 vide which the respondent No. 2 has been granted recognition by respondent No. 3. The same has been placed on record.

At this stage, learned counsel for the petitioner seeks permission of this Court to withdraw the present petition.

The petition is dismissed as withdrawn.
