W.P.(C) 12502/2018 Learned counsel on behalf of the petitioner has submitted that the petitioner earlier moved an application before the learned ADM for rectification of the error appearing on the records. He further submits that the said application was first allowed vide order dated 14.08.2017 as shown in Annexure P-6 and subsequently, the same was disallowed without issuing prior notice to the petitioner in the corrigendum order dated 26.12.2017 as shown in Annexure P-7.
Counsel for the petitioner has further submitted that consequently, the petitioner has filed an appeal qua against the order dated 26.12.2017 before the learned District Magistrate (Mehrauli-South) which is not being listed till date and the matter is yet to be decided. He further submits that he has issued a legal notice dated 20.08.2018. Despite issuance of legal notice, the process of hearing has not yet taken place and prays that the learned District Magistrate be directed to dispose of his appeal as per law at the earliest. Learned counsel on behalf of the respondent has got no objection if directions are issued to the learned District Magistrate to look into the appeal filed by the petitioner and dispose pof the same in accordance with law.
In these circumstances, the learned District Magistrate (Revenue) District-South, M.B. Road, Saket, New Delhi is directed to look into the appeal filed by the petitioner and dispose of the appeal within a period of three months.
The present petition is disposed of accordingly. Dasti.
