5. This is an application jointly filed by the parties praying that in view of the settlement arrived at between them on 23rd October, 2019, the appeal and the suit from which it arises, be disposed.
6. The Court notes that the application has been signed by the parties who are present in Court and confirm that the settlement agreement has been reached.
7. Accordingly, this application is allowed.

8. The settlement agreement dated 23rd October, 2019 is taken on record. The parties are bound by it. It shall be read as forming part of the present order.
9. The present appeal and the suit from which the appeal arises stand disposed of in terms of settlement agreement dated 23rd September, 2019.
10. The sum of Rs.94 lakhs together with the interest accrued thereon be released forthwith to the appellant by the Registry upon proper identification.
11. In view of the fact that the suit itself has been disposed of by way of the aforementioned settlement, a certificate will be issued by the Registry favouring the appellant as regards refund of the Court fee deposited by him in the suit.
