% 21.12.2018 This petition has been filed under Section 14 read with Section 15 of the Arbitration and Conciliation Act, 1996 seeking appointment of a substitute Arbitrator in place of the Arbitrator appointed by this Court vide order dated 27.10.2014 passed in CS (OS) No. 300/2013 and IA No. 7969/2013 titled Kishan Lal v. Ramji & Ors.

The Arbitrator by his e-mail dated 02.07.2018 has recused himself from the arbitration proceedings.

In spite of service of notice, none appears for the respondents. In view of the above the mandate of the Arbitrator appointed by this Court vide order dated 27.10.2014 is hereby terminated. I appoint Mr. Justice P.S. Teji, Retired Judge of this Court (B-46, Defence Colony, New Delhi-l10024, Mobile: 9910384615) as a Sole Arbitrator for adjudicating the disputes that have arisen between the parties.

The Arbitrator shall give disclosure under Section 12 of the Act before proceeding with the reference.

The arbitration proceedings will be taken up from the stage that they were at before the earlier Arbitrator. The parties shall be at liberty to collect the record from the earlier Arbitrator and file the same before the substitute Arbitrator. Incase of any difficulty, the parties may file the copies of the said record before the substitute Arbitrator.
