Mr. Sanjoy Ghose, learned senior counsel appearing on behalf of petitioner submits that the petitioner has entered into settlement with respondent no.1/Piramal Capital & Housing Finance Limited (formerly known as Dewan Housing Finance Corporation Limited) [hereinafter 'Piramal'], and in terms thereof, the petitioner has repaid in full the outstanding amount.

He has also handed over No Objection Certificate dated 31.07.2024 issued by Piramal. The same is taken on record. 3.

In view of the above development, Mr. Ghose seeks liberty to withdraw the present petition. facility availed by the petitioner, have been lost. He submits that the said list of documents have been enumerated at serial no. 3-7 of the list of documents handed over across the Bar. The said list is taken on record. 4.

He submits that the petitioner reserves his right to seek indemnification from the respondent no.1/Piramal in case the petitioner suffers any loss on account of misplacement of documents. 5.

The learned counsel on behalf of respondent nos.1 and 2 submits that they have no objection in case the request of the petitioner is granted. 6.

The petition alongwith pending application is dismissed as withdrawn with liberty as aforesaid.
