After some arguments, learned counsel appearing for the petitioner seeks to withdraw the present petition with liberty to file afresh after the independent witnesses have been examined.

Considering that the petitioner has been in custody for over two years, this Court directs the trial court to ensure that the independent witnesses (which this Court is informed are five in number) are examined as expeditiously as possible and in any event within a period of five months from 17.05.2020. The petitioner is at liberty to apply afresh after the said witnesses have been examined.

The petition is dismissed as withdrawn with the aforesaid observations.
