O R D E R
(ORAL) Petitioner seeks bail in FIR 503/2015, under Section 439 Cr.P.C. r/w Section 482 Cr. P.C., registered at police station New Friends Colony, New Delhi on the ground that the evidence of the complainant/first informant is discrepant.
Learned counsel for petitioner has sought to point out the discrepancy regarding the date and time of incident to submit that the prosecution version is not reliable.
Upon hearing and on perusal of copy of deposition of the complainant/first informant, I prima facie find discrepancies pointed out in the version of complainant, do not justify grant of bail to BAIL APPLN. 2743/2018
petitioner, who is facing trial for commission of offences under Sections 395/397 of IPC and 25/27 Arms Act.
Accordingly, this application is dismissed while not commenting on the merits of the case.
