% 06.05.2016 I.A. No. 5600/2016 This application has been jointly moved by the parties under Order 23 Rule 3 CPC to record their settlement. The original settlement agreement dated 05.04.2016 is placed on record. The same has been signed by the parties, their respective counsels and the learned mediator. The terms of the settlement appear to be fair, just and reasonable and I see no impediment in accepting the same. Accordingly, the suit is disposed of as settled in terms of the settlement, which shall continue to bind the parties.

The site plan, which demarcates the areas falling to the share of the respective parties, filed along with the settlement shall form part of the

settlement.

The plaintiff shall be entitled to refund of the entire court fees since the disputes have been settled in mediation.
