Petitioner has been produced in custody. Medical Report has also been filed by the Superintendent, Jail indicating that the petitioner was taken to Mahindru Hospital and the date of surgery was fixed for 8th January, 2019 and the petitioner was asked to deposit demand draft for a sum of `35,000/- for open surgery and `80,000/- for laproscopic surgery. He states that he has `20,000/- in his account and he is going to shortly receive another `15,000/- from his family which will be deposited with the Mahindru Hospital.

In view of this statement of the petitioner, the Superintendent, Tihar Jail is directed to take the petitioner to Mahindru Hospital and get a fresh date of surgery the moment he receives another `15,000/- so that the expenses can be borne by the petitioner and his surgery is got conducted BAIL APPLN. 2737/2018

immediately.

In the meantime, petitioner states that if released on bail, he would stay with Mr.Pattrick whose address will be provided by learned counsel for the petitioner to learned APP for the State who would verify the same and file a status report.

List on 14th January, 2019.

In the meantime, if the money is received and the date of surgery is fixed, the petitioner be taken in custody to the Mahindru Hospital for performing the surgery and will be admitted there in custody with policeman in plain clothes. Further in case the money is not received or date of surgery is not fixed and the petitioner is not admitted, the petitioner will be produced in this Court by the Superintendent, Tihar Jail on the next date.
