Petitioner impugns order dated 03.07.2018 whereby the leave to defend application of the petitioner has been dismissed and an eviction order passed. Subject eviction petition was filed by the respondent seeking eviction of the petitioner on the ground of bonafide necessity under Section 14(1) (e) of the Delhi Rent Control Act, 1958, in respect of one room/shop bearing No.1408/7 on the ground floor of the property No.1408, Gali Teliyan, Tilak Bazaar Chowk, Delhi.

Learned counsel for the petitioner submits that on account of amicable settlement, petitioner has already surrendered his tenancy and vacated the premises and handed over peaceful vacant possession of the tenancy premises to the respondent on 21.10.2019. 3.
Learned counsel for the petitioner seeks leave to withdraw the petition.

Petition is dismissed as withdrawn.
