The present application has been filed by the petitioner/ accused under Section 438 Cr.P.C. for the grant of pre-arrest bail in FIR No.15/2015, under Sections 420/468/471/120-B IPC, Police Station Chanakyapuri.
The present petition came up for hearing on 07.09.2015 and notice of the petition was given to the State. On 14.09.2015, interim protection was granted to the petitioner with the direction to him to appear before the Investigating Officer on 15.09.2015 at 04.00 p.m. in the Police Station, Chanakyapuri, Delhi.
It has been submitted by the learned Additional Public Prosecutor for the State that the petitioner/accused has already joined the investigation. Admittedly, no recovery is to take place from the petitioner/accused and as such no custodial interrogation of the accused is required.
In the facts and circumstances, the application is allowed. It is hereby ordered that in the event of arrest of the petitioner/accused, he shall be released on bail on furnishing the personal bond in the sum of Rs.15,000/- with one surety in the like amount to the satisfaction of the arresting officer. However, the petitioner is directed to join the investigation as and when required. He is directed not to leave the country without prior permission of the Court concerned. He is further directed not to tamper with the evidence and not to influence the prosecution witnesses.
