O R D E R

% 05.02.2019 By this petition the petitioner seeks parole on the ground that he has to file a special leave petition, arrange resources for the same and re-connect social ties. The application of the petitioner by the GNCT was rejected on the ground of adverse Police report stating that there is no control of any family member on the convict.

Status report has been filed. As per the status report mother of the petitioner was found residing at Sonipat who stated that she had fallen from the roof three years back and got an injury causing her inconvenience. She further stated that she had three sons, the petitioner being the eldest and besides him one Shripal and the other Ranjeet and a daughter Pinki who is already married. On verification it was further found that brother of the W.P.(CRL) 3683/2018

petitioner namely Shripal had changed his residential address to H.No. 13A, Gali No.6, Prem Vihar, Najafgarh where he was found residing with his wife and son. The brother of the petitioner has no objection if the petitioner stays with him during the period of parole. It is thus evident that petitioner has roots in the society. His mother is staying in Sonipat and the brother staying in Najafgarh which facts have been verified.

As per the nominal roll petitioner has been in continuous custody from 19th April, 2013 till date. The appeal filed by the petitioner was dismissed by this Court on 28th August, 2018. Hence this Court deems it fit to grant parole to the petitioner. It is therefore directed that the petitioner be released on parole for a period of four weeks on his furnishing a personal bond in the sum of ₹25,000/- with one surety bond of the like amount to the satisfaction of the learned Trial Court.

Petition is disposed of.

Copy of this order be communicated to the petitioner through Superintendent Tihar Jail.
