% 20.12.2017 Today in Court, learned counsel for the plaintiff and the defendants have handed over separate memorandum of settlement, which are taken on record. Both the counsel state that the Memorandum of Settlements handed over by them contain identical terms. They state that as plaintiff and defendants are based in Bombay and Roorkee respectively, they have taken the liberty of signing separate, but identical copies of memorandums. The memorandum of settlements are also supported by affidavits of the respective parties.
Both the learned counsel state that the matter has been compromised in accordance with the aforesaid Memorandum of Settlements dated 1st December, 2017 and 20th December, 2017.
Both the learned counsel further assure and undertake to this Court that the parties shall comply with the Settlement terms mentioned in the aforesaid Memorandum of Settlements.
The aforesaid statements, assurances and undertakings as well as undertakings given by learned counsel for the parties are accepted by this Court and parties are held bound by the same. This Court has also perused the Memorandum of Settlements and is of the opinion that they are lawful.
At this stage, learned counsel for the defendants has handed over to learned counsel for plaintiff a Pay Order No. 835685 dated 13th December, 2017 for Rs. 20,000/- in favour of Axis Bank Ltd., Chandni Chowk, Delhi, as token compensation in full and final settlement. Consequently, the suit is decreed in accordance with the Memorandum of Settlements dated 1st December, 2017 and 20th December, 2017, which are marked as Ex. C-1 and C-2 respectively. Registry is directed to prepare a decree sheet accordingly. With the aforesaid observations, present suit and all pending applications stand disposed of.
