% 13.03.2018 Counsel for the petitioner states that after filing of the present writ petition, a show cause notice dated 28th November, 2017, under Section 124 of the Customs Act, 1962, has been issued by the Directorate of Revenue Intelligence. He states that reply was filed by the petitioner and other co-noticees on 18th January, 2018. Counsel for the petitioner submits that in view of the aforesaid position, he would withdraw the present writ petition without prejudice to his rights and contentions and with liberty to raise all contentions before the adjudicating authority. He states that an

application under Section 110A of the Customs Act, 1962 has been filed by the petitioner before the adjudicating authority. He requests that the adjudicating authority should be directed to dispose of the show cause notice expeditiously.

We take the statement on record and the writ petition is dismissed as withdraw without commenting on merits. The adjudicating authority, we hope and trust would proceed expeditiously and in accordance with law.
