O R D E R

% 24.10.2017 Learned counsel for the petitioner submits that there is no eye witness to the alleged incident.

The whole case of prosecution is based upon circumstantial evidence.

As per the prosecution, deceased was last seen with the petitioner by his two sisters namely Sonia and Suman. Nothing has been recovered from the petitioner. There is nothing against the petitioner except the last seen evidence.

Sonia and Suman have already been examined as PW-2 and PW-3 and they have not supported the prosecution story of last seen.

On instructions, learned APP has admitted that nothing was recovered from the petitioner.

Keeping in mind the totality of facts and circumstances, it is ordered that petitioner be released on bail subject to his furnishing a personal bond in the sum of `10,000/- (Rupees Ten Thousand Only) with one surety of the like amount to the satisfaction of the Trial Court. Bail application is disposed of in the above terms. Dasti.
