Petition under Section 482 Cr.P.C has been filed for quashing the Criminal Complaint Case bearing CC No.468709/16 (Previous No.998/1/14) P.S. B.K.Road under Section 138 N.I.Act.

Learned counsel for the Petitioner submits that it was the cheque given as advance payment for performance of the contract which is not a legally enforceable debt and, therefore, the Summoning Order is bad in law and the Complaint is liable to be quashed.

Learned counsel on behalf of the Respondent submits that the matter is now pending at the stage of defence evidence. 4.

In view of the submissions made, the Petition is disposed of with liberty to the Petitioner to take his defences as agitated herein before the Trial Court in accordance with law.

Petition is disposed of.
