% 01.12.2017 Respondents have been served, however, none appears for the respondents. They are proceeded ex-parte.
It is brought to my notice by the counsel for the petitioner that Arbitral Tribunal has already been constituted for adjudication of the disputes that have arisen between the parties. The Arbitrator has already entered reference.
As the Arbitral Tribunal has already been constituted, I deem it appropriate to direct that the present petition would be considered as an application under section 17 of the Arbitration and Conciliation Act, 1996 by the Arbitrator and shall be considered on its own merits. It will be open to the respondent to raise all contentions in opposition thereto before the Arbitrator.
The interim order granted in favour of the petitioner vide order dated 18.09.2017 is extended for a period of four weeks from today. It shall be open to the Arbitral Tribunal to extend/modify/vacate the
same in accordance with the law.
