The above two Petitions under Section 482 Cr.P.C have been filed on behalf of the Petitioner for quashing of the Complaint Case No.518177/2016 under Section 138 NI Act and all the proceedings emanating therefrom as well as the Order dated 03.03.2017 and Summoning Order dated 08.01.2014 of learned M.M vide which the Petitioner has been declared as Proclaimed The authenticity of the order can be re-verified from Delhi High Court Order Portal by scanning the QR code shown above. Offender.

It is submitted in the Petitions that the Complainant/Respondent had sent a Notice dated 29.11.2013 for payment of the cheques bearing No.842439 and 842440 since they got dishonoured by the Bank. The Complaint under Section 138 NI Act is filed on 20.12.2013 against the Petitioner, who got summoned vide Order dated 08.01.2014. However, he was unable to appear and was declared an Absconder vide Order under Section 82 Cr.P.C dated 03.03.2017. Thereafter the file got consigned sine die on account of the Petitioner having been declared an Offender under Section 82 Cr.P.C.

The Petitioner is at liberty to move an appropriate Application before the learned M.M in regard to the Complaint as well as the Order declaring him Proclaimed Offender, who may consider it in accordance with law along with considering whether the Complaint needs to be revived. 4.

The above two Petitions are according disposed of along with pending Applications.
