By way of this application filed under Section 439 Cr.P.C. the petitioner is seeking interim bail in case FIR No.94/2016, registered at PS Pul Prahlad Pur, under Sections 307/506 IPC & 27/54/59 Arms Act. 2.

The petitioner is seeking bail on the grounds that his widow mother is suffering from MRD Grade-2 i.e. kidney failure and has placed on record the clinical summary by Dr.Gajinder Nayyar, Nirmal Nursing Home, Dwarka.

A certificate issued by a private practitioner, who is a doctor having MBBS degree, in a private nursing home is not a specialist to treat the patient of kidney failure.

In view of the above, the application of the petitioner for grant of interim bail is dismissed. However, the petitioner is at liberty to file afresh after submitting complete medical record and certificate from any reputed Private/Government hospital.
