O R D E R

This order is in continuation of the earlier orders dated 20th September, 2017 and 2nd November, 2017.

After some further parleys in the Court, it has been agreed between the parties through counsels that on the respondents/defendants jointly and severally paying a sum of Rs.43,00,000/- (Rupees Forty Three Lakhs only) to the petitioners/plaintiffs on or before 31st March, 2018 with interest @ 10% p.a. with effect from 1st December, 2017 on the reducing balance, the entire claim of the petitioners/plaintiffs against the respondents/defendants in the Suit from which this petition arises shall stand satisfied. It has further been agreed that if for any reason the entire amount is not so paid on or before 31st March, 2018, the respondents/defendants shall then be liable for the entire Suit amount of Rs.50 Lakhs with interest @ 10% p.a. from the date of institution of the Suit till the date of realization less the amounts paid CM(M) 1055/2017

till then and the respondents/defendants shall then be also liable for costs of the Suit and this petition with the counsels' fee assessed at Rs.50,000/-. 3.

The aforesaid compromise is found to be lawful and is allowed. 4.

This petition is disposed of by passing a decree in favour of the petitioners/plaintiffs and jointly and severally against the respondents / defendants in terms of the compromise aforesaid and with this order forming part of the decree sheet.

A copy of this order be forwarded to the Suit Court which is requested to pass a decree in terms hereof.

It is also directed that in the event of the entire amount being paid in terms of the compromise before 31st March, 2018, the petitioners/plaintiffs shall also be entitled to a certificate from the Suit Court entitling the petitioners/plaintiffs to refund of 60% of the court fees paid on the plaint.
