This petition under Section 11 of the Arbitration and Conciliation Act, 1996 has been filed seeking appointment of a sole arbitrator for adjudication of the disputes that have arisen between the parties under the Lease Agreement dated 28th May, 2015. 2.

The Counsel for the respondent submits that a reply has been filed , however, the same is not on record. He submits that in the reply, he has suggested names of various persons who may be appointed as arbitrator for adjudication of the disputes. However, without prejudice, he submits that the respondent would have no objection if the parties are referred to the Delhi International Arbitration Centre (DAC) for appointment of an arbitrator for adjudication of the disputes.

I accordingly, direct the parties to appear before the DAC on 20th December, 2017 at 2 PM. DAC shall appoint a sole arbitrator for adjudication of the disputes between the parties under or in connection with the Lease Agreement dated 28th May, 2015. The arbitration and the fee shall be governed by the rules of the DAC. All contentions of either parties would remain open before the Arbitral Tribunal so constituted. 4.
