O R D E R

% 18.09.2017 By this petition under Section 12 read with Section 2(B) of Contempt of Courts Act, the petitioner (respondent in appeal) seeks to initiate contempt proceedings against the respondent (appellant in appeal).

Counsel for the petitioner submits that vide order dated 10th August 2017, this court had made the stay order absolute. However, he has not filed the copy of that order, but has shown the certified copy of the same.

After perusing the order dated 10.08.2017, this court observes that on that date the application for stay was finally decided, amount had already been deposited. In the considered opinion of this court, it is an act of concealment on the part of the petitioner regarding the order passed subsequent to the orders referred in the application.

After considering the orders passed in the main appeal, this court finds that no contempt is found to be made out on behalf of the respondent, accordingly the present contempt petition filed by the petitioner is dismissed.
