O R D E R

% 22.09.2017 It is submitted that petitioner and respondent no.2 have settled their disputes amicably, therefore, FIR No. 280/2017 under Section 420 IPC registered at police station Sultanpuri may be quashed. Respondent no.2 is present in Court and has been identified by SI P.K. Rao of police station Sultanpuri.

Respondent no.2 admits having settled the matter with the petitioner vide Agreement dated 5th September, 2017. He further submits that out of the total settled amount, that is, `10 lacs, he has already received `5 lacs and for remaining settled amount he has been handed over five post dated cheques of `1 lac each by the petitioner. Counsel for the petitioner, on instructions, submits that these post dated cheques will be honoured on the due dates. In view of the settlement, respondent no.2 submits that he has no

objection if the FIR is quashed subject to, however, encashment of the post dated cheques, as detailed in para 3 of the Agreement. Keeping in view the settlement arrived at between the petitioner and respondent no.2, FIR No. 280/2017 under Section 420 IPC registered at police station Sultanpuri, which is at the investigation stage, is quashed subject to, however, encashment of aforementioned five post dated cheques. In case any of the post dated cheques is dishonoured, present FIR shall stand revived.

Petition is disposed of in the above terms.
