Ravi Chopra v. Nirmala Devi
$~49 *
IN THE HIGH COURT OF DELHI AT NEW DELHI
+ CONT.CAS(C) 656/2017 & CM APPL. 34631/2017 RAVI CHOPRA ..... Petitioner Through Mr. Abhay Kumar, Adv.
versus NIRMALA DEVI ..... Respondent Through None.
CORAM:
HON'BLE MR. JUSTICE A. K. CHAWLA
O R D E R
% 20.09.2017 Petitioner alleges violation of the orders dated 16.08.2016 and 20.09.2016 passed by the Ld. Single Judge in WP(C) 8733/2015. Vide order dated 16.08.2016, the writ petition was disposed off with the observations, as follows:
"In this view of the matter, the petition is disposed of with liberty granted to the petitioner (co-jointly with respondent No.2 i.e.
co-owner and sister-in-law of the petitioner) to approach the Forest/ Tree Officer under the provisions of the Delhi Preservation of Trees Act, 1994 for appropriate remedy."
The abovesaid order was sought to be reviewed and the review petition came to be disposed off vide order dated 20.09.2016, being without any merit.
Ld .counsel for the petitioner contends that the liberty, that was granted to the petitioner to co-jointly approach the forest/tree officer under the provision of the Delhi Preservation of Trees Act, 1994, be
construed to be a direction to the co-owner, to join the petitioner in approaching the forest/tree officer. Contention raised is wholly misconceived. There is no such direction by the Court to any coowner to join the petitioner for the given purpose. Petition made is wholly misconceived and is dismissed.
