Bail Appl. No. 2134/2017 This is an application under Section 439 Cr.PC for seeking regular bail in case FIR No. 386/2015 under Section 365/392/397/34 IPC registered at Police Station - KamlaMarket.

The case of the prosecution is that the complainant along with Laxmi Singh came to Delhi with two suitcases and one carton given by his employer to deliver at Delhi and met Vijay Mishra and driver applicant/Sunil Purti, who came to receive them; that they boarded a car; that on their way accused persons robbed them at gun point and left them at an isolated place.

Status report has been filed by the State.

Learned counsel for the applicant contends that the applicant is in judicial custody since 10.09.2015; that the applicant has a clean antecedent and is the sole bread earner of his family comprising of three minor children and wife; that the applicant seeks parity since the other co-accused against whom the allegations are much serious than the present applicant, have already been enlarged on regular bail.

Learned APP for the State concedes that the other accused persons have been granted bail and chargesheet has already been filed against the accused persons and the matter is fixed for 06.12.2017 for prosecution evidence.

I heard the learned counsel for the parties and perused the material available on record.

Keeping in view the facts and circumstances of the present case, this Court finds it appropriate to grant regular bail to the applicant subject to his furnishing a personal bond in the sum of Rs.25,000/- with two sureties of like amount to the satisfaction of the Trial Court and further subject to : i) That the applicant shall not leave the National Capital Territory of Delhi without the prior permission of the Trial Court; ii) That the applicant shall remain present on each date of hearing before the Trial Court; and iii) That the applicant shall not directly or indirectly, make any inducement, threat or promise to any persons acquainted with the facts of the present case so as to dissuade them from disclosing such facts to the Court or to any other authority.

It is made clear that violation of any of the above terms and conditions, the State is at liberty to seek cancellation of bail of the applicant. Application stands disposed of.
