% 02.05.2018 After some hearing, the counsel for the respondent fairly conceded that the impugned order dated 29.07.2017 of the executing court on the file of the execution proceedings (Ex.95826/2016, old no.168/2016) may be set aside and the matter may be remitted to the executing court for reconsideration, in light of observations recorded in proceedings dated 26.09.2017 and 13.11.2017 of this court.

Ordered accordingly.

The impugned order as aforesaid is set aside. The matter is remitted to the executing court for re-consideration after hearing the counsel for all the parties and bearing in mind the observations recorded in the aforementioned two orders, copies whereof shall also be placed before the executing court CM(M) 1085/2017

for the needful compliance.

The parties shall appear before the executing court on 31st May, 2018. Given the old pendency of the matter, it is hoped and expected that the executing court will take a fresh call on the issues raised at an early date. The petition stands disposed of in above terms. R.K.GAUBA, J.
