% 02.11.2017 Respondent no.2 Ms. Jatinder Kaur is present in the court and has been identified by W/SI Siksha of police station Dwarka (South). Respondent no.2 says that she has settled the matter with petitioner vide settlement deed dated 30th November, 2015 of her own free will and without any undue force, pressure or coercion. She further submits that her marriage with the petitioner has already been dissolved by a decree of divorce by mutual consent passed by the Family Court, South-West District, Dwarka Courts, Delhi on 28th July, 2016. Respondent no.2 further submits that in view of the settlement, she is not willing to pursue the FIR No. 347/2013 under Sections 498A/406/506/34 IPC registered at PS Dwarka (South), Delhi against the petitioner any further and the same may be quashed.
Keeping in view the facts and circumstances of the case as detailed above more particularly, the fact that marriage between the petitioner and respondent no.2 has already been dissolved, in the interest of justice, FIR No. 347/2013 under Sections 498A/406/506/34 IPC registered at PS Dwarka (South), Delhi and the consequents proceedings emanating therefrom, are quashed.
Petition is disposed of in the above terms.
