% 22.11.2017 Both the learned counsels for parties submit that in a similar matter being Arb. Petition No.607/2017, vide an order dated 27.10.2017 the Coordinate Bench of this Court has already appointed Mr.Akshay Makhija, Advocate (M. No.9810079901) as the learned arbitrator. The learned counsel for the respondent submit if the original agreement dated 01.12.2014 is placed on record by the petitioner, he has no objection for the appointment of Mr.Makhija, Advocate as the arbitrator in this case as well. The learned counsel for the petitioner has no objection to it.

In the circumstances, Mr.Akshay Makhija, Advocate (M. No.9810079901) is hereby appointed as the learned arbitrator to arbitrate the disputes between the parties in relation to agreement dated 01.12.2014. The fee of the learned arbitrator shall be governed by the Schedule - 4 of the Arbitration and Conciliation Act, 1996.

The petition stands disposed of. The original arbitration agreement shall be filed by the petitioner in Court within 3 days from today.
