% 11.02.2019 The Court has heard learned counsel for the parties. During the course of the hearing, the Court was of the opinion that it would not be appropriate to exercise writ jurisdiction in respect of the impugned order since the petitioner is an assessee subject to the jurisdiction of the income tax authorities at Madhya Pradesh.
In view of the matter, learned counsel sought liberty to withdraw the writ petition and approach the Madhya Pradesh High Court. However, he also sought extension of interim order which had bound the parties till date. In view of the statement made, the interim order which has enured in favour of the petitioner shall continue for three weeks. The writ petition is accordingly dismissed as withdrawn along with the pending application but in the above terms.
