versus ZEAL DEVELOPERS PVT . LTD ..... Respondent Through Mr.Pramod B. Agarwala and Mr.Aayush Agarwala, Advs.

CORAM:

HON'BLE MR. JUSTICE NAVIN CHAWLA

O R D E R

% 27.10.2017 Learned counsel for the respondent has entered appearance. He has also tendered his Vakalatnama. He submits that his only objection to the appointment of the Arbitrator is that the petition as filed is not in compliance with the scheme as formed by Delhi High Court, inasmuch as the original Arbitration Agreement has not been filed along with the petition nor any exemption has been sought. He however, fairly conceded that sole arbitrator may be appointed leaving all the contentions of the respondent open, including non-furnishing of the original Arbitration Agreement. Learned counsel for the petitioner has no objection to the same. In view of the above, I appoint Mr.Akshay Makhija, Advocate, Chamber No. 5, Lawyers Chambers, High Court of Delhi, Shershah Road, New Delhi-110003, (Mob. No. 9810079901), as sole arbitrator to adjudicate the disputes between the parties. Parties to appear before him on 10th

November, 2017 at 3.30 p.m. The sole arbitrator shall fix his fee in accordance with the Schedule-4 of the Arbitration and Conciliation Act, 1996.

The petition is disposed of in the above terms. NAVIN CHAWLA, J OCTOBER 27, 2017/vp
