Mr. Digpaul, learned counsel for the respondents hands over a copy of the movement order dated 13.04.2018 issued in respect of the petitioner and two others that reveals that he has been posted to Trichy. A copy of the said movement order is taken on record with a copy furnished to learned counsel for the petitioner.

In view of the above, the prayer clause (ii) in the present petition does not survive and is deleted. As for the remaining prayers made in the present petition, we are informed by learned counsel for the respondents that ordinarily, a force personnel is granted one month's time to vacate the staff quarters. However, the petitioner has not vacated the staff quarters occupied by his family in Ghaziabad till date.

Learned counsel for the petitioner assures this Court that the petitioner shall vacate the family quarter allotted to him at Ghaziabad within 30 days from today.

Mr. Digpaul, learned counsel for the respondents draws the attention of this Court to the O.M. dated 11.08.2016 issued by the DoPT, Government of India on the subject of "Special concession to Central Government Employees Working in Kashmir Valley" and submits that if the petitioner vacates the staff quarter occupied by him in Ghaziabad and submits a representation to the respondents for waiver of the penal rent, based on the aforesaid O.M., then his case can be re-examined by the Department. 5.

Learned counsel for the petitioner states that his client shall make a representation as suggested above.

As and when such a presentation is received from the petitioner, the respondents shall consider the same and pass a speaking order thereon under written intimation to him.

The petition is disposed of.
