% 09.02.2018 It is submitted that petitioners and respondent no.2 are related to each other. Property disputes between the petitioners and respondent no.2 had led to registration of FIR No. 74/2011 under Sections 120B/465/466/467/468/ 473/34 IPC at police station Civil Lines, on the complaint of respondent no.2. It is further submitted that all the disputes have been resolved between the petitioners, respondent no.2 and their other relatives vide Settlement Agreement dated 10th August, 2017, therefore, aforesaid FIR and the consequent proceedings may be quashed. It is also submitted that Settlement Agreement has already been accepted in Crl. M.C. 3941/2017 whereby FIR
No. 239/2011 under Sections 420/120-B/468/471/406/34 IPC registered at Economic Offences Wing has been quashed by a learned Single Judge of this Court vide order dated 22nd September, 2017. Respondent no.2 is present in Court and has been identified by SI Robin Singh of police station Civil Lines.
He admits having settled the matter with the petitioners vide Settlement Agreement dated 10th August, 2017 of his own free will and without any undue force, pressure or coercion. he also admits having received entire settled amount of `1 lac. He has no objection in case the FIR is quashed.
Keeping in mind the settlement between the petitioners and respondent no. 2 voluntarily, in the interest of justice, aforesaid FIR and the consequent proceedings emanating therefrom are quashed. Petition is disposed of in the above terms.
