O R D E R

% 17.01.2018 Initially FIR was registered under Sections 448/511 IPC at Police Station Sonia Vihar on the complaint of Md. Mustkeem. Complainant alleged in the FIR that he along with his six friends had purchased 1494 square yards of land, forming part of Khasra nos. 46 and 47, Village Bakiyabad, Sonia Vihar, Delhi. On 24th January, 2016 he received a call from his employees that petitioner along with his co-accused had forcibly entered in the godown after broking the locks. He made a phone call at number 100. Police arrived at the spot. In the meanwhile, he also reached

there. However, local police did not cooperate with him despite the fact that he had showed them all the property documents including the order dated 14th December, 2012. Godown was sealed by the police under Section 145 Cr.P.C.

A kalandra under Section 107/115 Cr.P.C. was also made against him. Complainant claimed that his ownership rights were affirmed by the court vide order dated 14th December, 2012.

Investigations are complete and charge-sheet is stated to have been filed under Sections 448/452/342/506/120-B/511/34 IPC. Trial is pending. Petitioner is in custody for about 5 months Learned APP, who is assisted by the learned counsel for complainant, submits that petitioner sold the same property in favour of two different persons and duped them to the tune of `1 crore. Learned counsel for the petitioner submits that no offence under Section 420 IPC has been added in the charge-sheet. Keeping in mind the totality of the facts and circumstances of this case, petitioner is admitted to bail, subject to his furnishing a personal bond in the sum of `25,000/- (Rupees Twenty Five Thousand Only) with one surety in the like amount to the satisfaction of the trial court.

Bail application is disposed of in the above terms. Miscellaneous application is disposed of as infructuous.
