% 13.12.2017 By the present petition the petitioner had sought quashing of FIR No. 9/2017 under Sections 420/468/471 IPC registered at PS Saket, Delhi on the ground that parties have settled the matter.

On a notice being issued, learned counsel for respondent No.2 along with respondent No.2 enters appearance and states that at the time of grant of bail, a settlement was arrived between the parties however, the petitioner has not acted on the settlement.

In view of this statement of learned counsel for respondent No.2 on instructions from respondent No.2, the present petition is not maintainable and is thus dismissed with liberty to the petitioner to file a fresh one as and when a settlement is arrived at between the parties. MUKTA GUPTA, J.
