There has been no appearance on behalf of the petitioner for the last few dates of hearing as well.
Subsequent upon institution of the present petition, the Delhi Police registered a FIR No.552/2017, under Sections 323/325/34 IPC, Police Station- Hari Nagar, against nine officials of Central Jail, Tihar. After conducting the investigation, a closure report dated 12.04.2019, authored by SI Arvind, Police Station Crime Branch, has been filed before the Chief Metropolitan Magistrate (West), Tis Hazari Courts, in relation to the subject FIR.
In view of the foregoing, it is axiomatic that the incident, predicated on which the present writ petition was instituted, has since been investigated and is pending adjudication before the Court of competent jurisdiction. W.P.(CRL.) 2742/2017
The petition is accordingly dismissed as having been rendered infructuous, whilst reserving liberty to the petitioner to approach the Court of competent jurisdiction, in an appropriate proceeding, if any, in accordance with law.
