W.P.(CRL) 2772/2017 This is a petition under Article 226 of the Constitution of India filed by the husband seeking production of his wife. Mr.Mehra, learned standing counsel for the State has entered appearance on an advance copy having been served. Ms.Preeti has been produced in Court. Ms.Preeti submits that she has left her matrimonial home out of her own free will on account of harassment by her husband/the petitioner and his family members. She further submits that she is not staying with her parents as she fears that they would force her into joining back with her husband. She further submits that she has taken this decision out of her own free will and not under influence or coercion by any third person.
The matter has been taken up in the Chamber. We have also interacted with Ms.Preeti in the presence of Ms.Radhika Kolluru, learned APP for the State, who is present in another matter and Mr.Rahul Mehta, the standing counsel for the State.
In view of the stand taken by Ms.Preeti, petitioner does not press this petition. He submits the he would seek appropriate remedy as available in accordance with the law.
So far as Prayer (ii) is concerned, it would be open to the petitioner to make a complaint before the appropriate police station, which would be looked into in accordance with the law.
In view of the submissions made by the petitioner, the petition is dismissed as not pressed.
