After arguments, this appeal is disposed of as not pressed on merits but counsel for the appellants argues that costs of Rs.1 lakh imposed upon the appellants/defendants is harsh because in the present case the assessment order of property tax was passed in a situation where the landlord could have contested the assessment of the amount of property tax but the landlord failed to contest the assessment proceedings resulting in the order of assessment being passed with respect to property tax. 2.

In view of the aforesaid discussion, this appeal is disposed of as not pressed but the costs imposed of Rs.1 lakh as imposed by the impugned judgment are waived.
