This appeal has been preferred by the injured Manoj Kumar impugning the order on sentence dated 6th August, 2015 passed by learned ASJ, Dwarka Courts, Delhi in SC No. 93/15 arising out of FIR No.341/10 PS Dabri.

The appellant was aggrieved as the accused was ordered to be released on probation by learned ASJ for the reason that during the pendency of the trial some settlement took place which was duly recorded in the Court and appellant/injured has taken ` 1,00,000/- from the convict towards compensation.

One of the grievance of the appellant is that respondent no.2-accused was required to pay ` 3,00,000/- as compensation which fact was duly recorded in the statement of the appellant/injured made on 25th September, CRL.A. 999/2015

2014 before the learned ASJ while receiving part payment of ` 50,000/-. However, the balance amount of ` 2,00,000/- was not paid to him despite the accused being extended benefit of release on probation. 4.

The appellant has also placed on record copy of the petition filed by the parties for quashing of criminal proceedings which was dismissed as withdrawn.

Today it has been informed to the Court that the balance amount of `2,00,000/- , as agreed by the respondent No.2, has been paid to the appellant/injured.

In view of the above, learned counsel for the appellant seeks leave to withdraw the appeal.

The appeal is dismissed as withdrawn.
