% 18.01.2018 By this petition the petitioner seeks bail in case FIR No.1050/2015 under Sections 420/467/468/471/120B/34 IPC registered at PS Bhajan Pura. The above-noted case was registered on the complaint of Father Rev. J. Edwin John Wesley alleging that Evangelical Church of India (in short ECI) is a registered society having its office at Chennai with Bishop Rev. Dr. M. Ezra Sargunam as its President. The society has its own properties. It is alleged that society purchased property No. C-486, Khasra No. 343 & 306, Village Ghonda Gujran Khadar, Shahdara, Bhajan Pura, Delhi admeasuring 200 sq.yds. from Ms. Annie Rose Singh on 1st April, 1987 for developing a Church on the property.

The petitioner was deputed as pastor of the church and accommodation was also given to him. However, he duped the society and prepared a forged General Power of Attorney, agreement to sell, affidavit and receipt for a sum of ₹60,000/- and ₹80,000/- as consideration amount and sold the property to different persons.

The chain of documents pertaining to the forgery committed and unauthorized agreement to sell entered into have been partly recovered. FSL report has now been received. The petitioner has been in custody since 3rd January, 2017 except for two spells of interim bail granted by this Court. The evidence is primarily documentary, which has since been collected. Considering the nature of allegations and that the petitioner has been in custody for almost 10 months and the trial is likely to take time, this Court deems it fit to grant bail to the petitioner. It is therefore directed that the petitioner be released on bail on his furnishing a personal bond in the sum of ₹25,000/- with two surety bonds of the like amount subject to the satisfaction of the learned Trial Court, further subject to the condition that the petitioner will not leave the country without the prior permission of the Court concerned and in case of change of address the same will be duly intimated to the Court concerned.

Petition is disposed of. Order dasti.
