CORAM:

HON'BLE MR. JUSTICE A.K. PATHAK

O R D E R

% 07.11.2017 Respondent no. 3 is represented through his authorised representative, that is, respondent no. 2. Respondent nos. 2 and 4 are present in Court and have been identified by SI Sandeep Kumar of Police Station Kalyanpuri. It is submitted that petitioners are neighbours of respondent nos. 2 to 4. A perusal of FIR shows that a quarrel took place between the petitioners and respondent nos. 2 to 4 on some trivial issues, wherein petitioners assaulted the respondent nos. 2 to 4 in a fit of rage. Respondent nos. 3 and 4 sustained simple injuries in the quarrel. It is further submitted that petitioners and respondent nos. 2 to 4

have settled their disputes amicably; therefore, present FIR no.345/2012 under Sections 308/34 IPC registered at Police Station Kalyan Puri on the complaint of respondent no.2 and the consequent proceedings emanating therefrom, may be quashed.

Respondent nos. 2 and 4 submit that the matter has been settled with the petitioners by them as well as respondent no. 3 of their own free will, voluntarily and without any undue force, pressure or coercion. They further submit that they are not willing to pursue the FIR any further and the same may be quashed.

Keeping in view the fact that a quarrel took place between the neighbours on some trivial issue, which they have settled amicably in order to maintain harmonious relation in future, in the interest of justice, FIR no.345/2012 under Sections 308/34 IPC registered at Police Station Kalyan Puri and the consequent proceedings emanating therefrom are quashed. Petition is disposed of in the above terms. Miscellaneous applications are disposed of as infructuous. Dasti.
