O R D E R

% 12.10.2015 The petitioner seeks anticipatory bail in connection with FIR No.440/2015 (PS Bawana) instituted for offence under Sections 308/34 of the IPC.

It is alleged that the petitioner assaulted his aunt by means of an iron rod on her head leading to injuries on the parietal portion of the head. It has been submitted on behalf of the petitioner that the injuries suffered by the complainant has been opined to be simple in nature. He further submits that injury was because of accidental fall and the police, in collusion with the husband of the petitioner, has framed the petitioner in the instant case.

It is submitted that complainant is also having strained relationship with her husband. Learned counsel for the complainant has submitted that

the present assault was only for the purpose of preventing the complainant from staking any claim over the family property. Considering the nature of accusation, the strained relationship between the parties and the possibility of false accusation at the hands of the complainant, this Court is inclined to confirm the interim anticipatory bail granted to the petitioner.

The petitioner is directed to be released on bail on his arrest on his furnishing a bond in the sum of Rs.10,000/- with two sureties of the like amount to the satisfaction of the arresting officer. Needless to say that the petitioner shall participate in the investigation process and shall visit the police station as and when required by the investigating officer.

The application is disposed of accordingly.
