% 09.02.2018 By these petitions the petitioners seek anticipatory bail in case FIR No.390/2017 under Sections 323/341/452/506/34 IPC registered at PS Alipur.
The above-noted FIR was got registered by the complainant Smt. Jagmati Devi, the sister of petitioner Daryav Singh. Petitioner Avtar Singh is the son-in-law of Daryav Singh whereas petitioners Vicky and Savinder are the sons of Daryav Singh.
In the complaint Smt. Jagmati Devi stated that on 9th September, 2017 while she was present in her house and after she had taken meal she went out for fetching water when Babloo i.e. Avtar Singh came and caught her hair, her brother i.e. Daryav Singh attacked on her head with danda, which caused injury on her finger. Jagmati Devi further alleged that she somehow got freed from Daryav Singh but in the meantime Savinder stopped her and when her son Rahul came to save her accused Vicky assaulted Rahul. The nature of injury on Jagmati Devi has been opined as simple in
nature. Further, on the complaint of daughter of Daryav Singh and wife of Avtar Singh a FIR has already been registered against sons of Jagmati Devi which is prior in time.
Considering the nature of injury and the fact that the petitioners have already joined the investigation, this Court deems it fit to grant anticipatory bail to the petitioners. It is therefore directed that in the event of arrest the petitioners be released on bail on their furnishing a personal bond in the sum of ₹25,000/- each with one surety bond each of the like amount subject to the satisfaction of the Arresting Officer/ SHO concerned, further subject to the condition that they will join the investigation as and when directed and in case of change of residential address the same will be intimated to the Court concerned by way of affidavit.
Petitions are disposed of. Order dasti.
